1. Introduction

PLEASE READ THESE TERMS OF SERVICE ("Terms") CAREFULLY. BY ACCESSING OR USING ANY PART OF THE CYBEREXAMPREP WEBSITE, MOBILE APPLICATIONS, API, OR RELATED SERVICES (COLLECTIVELY, THE "Service"), YOU AGREE TO BE BOUND BY THESE TERMS AND BY OUR PRIVACY POLICY, WHICH IS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, DO NOT ACCESS THE SERVICE.

2. Eligibility & Account Registration

2.1 You must be at least thirteen (13) years old—or the minimum digital‑consent age in your jurisdiction—to create an account. 2.2 By registering, you represent that you meet this requirement and have legal capacity to enter into this agreement. 2.3 You agree to (a) provide accurate, current account information; (b) maintain the confidentiality of your credentials; and (c) accept responsibility for all activities that occur under your account.

3. License Grant & Acceptable Use

3.1 Subject to these Terms, CyberExamPrep LLC ("CEP," "we," "us," or "our") grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for personal, non‑commercial exam‑preparation purposes only. 3.2 You agree not to:

  • (a) copy, reproduce, publish, broadcast, or redistribute any Content (defined below) without CEP’s express written permission;

  • (b) reverse‑engineer, decompile, or attempt to derive source code, underlying ideas, or algorithms of any portion of the Service;

  • (c) use bots, scrapers, or other automated means to access the Service;

  • (d) engage in any activity that interferes with or disrupts the Service or servers; or

  • (e) violate any applicable law, regulation, or exam‑vendor nondisclosure agreement.

4. Intellectual‑Property Rights

4.1 All practice questions, explanations, software, graphics, and trademarks on the Service ("Content") are owned by CEP or its licensors and are protected by U.S. and international copyright, trademark, and other laws. 4.2 Except for the limited license in Section 3, you obtain no ownership or other IP rights. All rights not expressly granted are reserved. 4.3 Educational Use Only. All materials are intended solely to help users master published exam objectives. They are not actual exam items, disclosed NDA content, or “brain‑dump” questions. All practice questions are independently authored by CEP using industry‑standard item‑writing guidelines. They are not actual exam items, brain‑dump material, or content subject to vendor NDAs.

5. Third‑Party Trademarks & No Affiliation

CyberExamPrep is an independent platform **NOT endorsed by—and NOT affiliated with—**CompTIA®, AWS®, Cisco®, ISC2®, EC‑Council®, or any other certification body. Their names and exam titles appear solely for nominative‑fair‑use reference.

CompTIA®, A+®, Network+®, and related marks are registered trademarks of CompTIA, Inc. AWS® and the AWS logo are trademarks of Amazon Technologies Inc. Cisco® is a trademark of Cisco Systems, Inc. ISC2® is a registered trademark of the International Information System Security Certification Consortium, Inc. All other trademarks are the property of their respective owners. Use herein is for identification only and does not imply endorsement.

6. User‑Generated Content ("UGC")

6.1 If the Service allows you to post usernames, avatars, messages, or other UGC, you retain ownership of your submissions but grant CEP a worldwide, non‑exclusive, royalty‑free, sublicensable license to host, display, and distribute such UGC in connection with the Service. 6.2 CEP may remove any UGC that violates these Terms or applicable law.

7. Payments, Subscriptions & Refunds

7.1 App‑Store Transactions. Mobile purchases are processed by Apple App Store or Google Play, and those marketplace terms govern billing, taxes, and refunds. Purchases are linked to your Apple ID or Google account and are non‑transferable between accounts. 7.2 Lifetime Unlock. “Lifetime access” means for as long as CEP commercially operates the relevant portion of the Service. CEP may discontinue the Service with 90 days’ prior notice sent to the email on file. 7.3 CEP cannot issue refunds for app‑store purchases; request any refund through the original marketplace. 7.4 EU/UK Digital Goods. Residents of the EEA or UK have a statutory 14‑day right to withdraw from digital‑content purchases unless they expressly waive that right at checkout by consenting to immediate access. App‑store flows obtain this consent on our behalf. 7.5 You are responsible for any VAT, GST, or similar taxes imposed on your purchases, except taxes based on CEP’s net income.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. CEP SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. USE OF THE SERVICE DOES NOT GUARANTEE ANY EXAM PASSING SCORE, AND CEP DOES NOT WARRANT THAT CONTENT IS ERROR‑FREE OR UP‑TO‑DATE.

9. Limitation of Liability

To the maximum extent permitted by law, CEP will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of (or inability to use) the Service. CEP’s total aggregate liability shall not exceed the amounts you paid CEP (if any) in the six (6) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless CEP, its officers, employees, and contractors from any third‑party claim or demand (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.

11. Contest, Coins & Promotions Disclaimer

Apple Inc. and Google LLC are not sponsors of, nor responsible for, any contests, coin systems, or other promotions within the Service.

12. DMCA Notice & Procedure

CEP respects intellectual‑property rights. If you believe Content on the Service infringes your copyright, send a notice pursuant to 17 U.S.C. § 512(c)(3) to the Copyright Agent below. Upon receipt, CEP will expeditiously remove or disable the disputed material.

13. Termination

CEP may suspend or terminate your account immediately, without notice, if you breach these Terms or engage in abusive, fraudulent, or illegal activity. Upon termination, all licenses granted to you shall cease, but Sections 4–15 shall survive.

14. Governing Law & Dispute Resolution

14.1 These Terms are governed by the laws of the State of Maryland, U.S.A., without regard to conflict‑of‑law principles.
14.2 Arbitration. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association. Judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class‑Action Waiver. You waive any right to participate in class‑action or class‑wide proceedings.

15. Modifications to Service & Terms

CEP may (a) modify or discontinue any feature or content; and (b) update these Terms at any time. We will post the revised version with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. International Users & GDPR

16.1 CEP’s data‑processing practices are described in our Privacy Policy. CyberExamPrep LLC is the data controller for personal data processed under these Terms.
16.2 EU/EEA/UK residents have the right to access, rectify, erase, or port their personal data and to object to certain processing. You may exercise these rights by emailing [email protected].
16.3 CEP’s lawful bases for processing include contract performance (providing the Service) and legitimate interests (fraud prevention, product analytics). Where consent is required, you may withdraw it at any time without affecting prior processing.
